Effective January 1, 2025, the Illinois Supreme Court (the “Court”) implemented new guidance on the use of Artificial Intelligence (“AI”) to promote equitable access to justice. In creating its policy, the Court acknowledged the fast development of AI technologies and raised concerns about “authenticity, accuracy, bias, and the integrity of court filings, proceedings, evidence, and decisions.”
Highlights of the policy include:
- Encouraging the responsible use of AI;
- Not requiring mandatory disclosures of the use of AI in court filings;
- Requiring users to adhere to existing legal and ethical standards; and
- Requiring users to be aware of the potential risks and concerns of AI use.
The Court recognizes the growing significance of AI technology. It does not discourage its use. It authorizes such use only under existing legal and ethical standards as laid out in the Rules of Professional Conduct and the Code of Judicial Conduct. The Court urges attorneys to be aware of the capabilities and limitations of AI technology, and to be aware of their ethical duty to take reasonable precautions in their use of AI programs to protect privileged or confidential information.
