On May 29, 2024 we reported that the Federal Trade Commission (“FTC”) had issued a final rule that would ban non-competition clauses between workers and employers, deeming them “an unfair method of competition” in violation of Section 5 of the FTC Act. Read the full article here.
The ban was scheduled to take effect on Sept. 4, 2024. Due to a court injunction, the ban is on hold. We will let you know if and when a new rule takes its place.
